— After nearly three decades in the military, William T. Russell’s latest mission has brought him to Johnstown.The career Army man, just two years short of retirement, has left the service and moved to the Flood City in order to mount a political campaign against veteran Democratic U.S. Rep. John Murtha.As a Republican and first-time candidate facing a powerful congressman in the sprawling, Democrat-dominated 12th Congressional District, Russell faces a tough challenge.But he is determined to press ahead and will formally announce his candidacy within weeks.“I recognize this is an uphill battle,” Russell said in an interview last week at The Tribune-Democrat. “But it’s one that must be fought.”Murtha, who declined any comment on Russell’s candidacy when contacted through a spokesman last week, has served in the House since 1974.The 75-year-old is known for bringing money and jobs – especially in the defense sector – to his district, and last year he became chairman of the House Defense Appropriations Subcommittee.But Murtha’s repeated calls for a military withdrawal from Iraq and his criticism of the Bush administration have spurred a backlash among conservatives.Republican Diana Irey, a Washington County commissioner, tried to capitalize on that sentiment during her 2006 campaign against Murtha. But the congressman cruised to victory.Russell, 45, is betting on a different result next year. He readily acknowledges that he moved to Johnstown from the Washington, D.C., area specifically so that he could run in the 12th District.Murtha is a decorated Vietnam War veteran. But Russell also has extensive military credentials.Born on an Air Force base in Newfoundland, Canada, Russell’s long Army and Army Reserve career includes duty in the Balkans and in both Iraq wars.Russell and his wife, Kasia, were in the Pentagon when a hijacked jetliner crashed into the building on Sept. 11, 2001. They escaped unharmed.While Murtha’s encounters with wounded soldiers have solidified his stance on Iraq, Russell said a similar encounter left him with the opposite impression: To withdraw from Iraq, he argues, would render the sacrifices of those soldiers pointless.“I think Mr. Murtha is just flat-out wrong,” Russell said.The Republican also cites, as Irey did, Murtha’s public accusation that U.S. Marines murdered innocent civilians in the Iraq town of Haditha in 2005.The congressman, Russell contends, is “playing right into the hands of this enemy.” On his Web site, Russell takes that line of thought a step further and attempts to raise the stakes for next year’s election.“In this war against Islamic radicalism, the political battle of the 2008 election in the Pennsylvania 12th Congressional District is a critical turning point,” he said.Russell’s platform is not limited to the Iraq issue.He seeks to turn a long history of substantial economic clout against Murtha, arguing that the congressman is an “extreme practitioner of cronyism” who has not created long-term, sustainable jobs in this area.As a small-business owner who operates an ATM company, Russell says he wants to help create a local economy that is more dependent on the free market – while also acknowledging that some jobs may be lost if governmental contracts disappear.“A lot of folks have gotten very, very dependent on this ‘pork’ structure,” Russell said.Russell still has significant hurdles to clear before he can legitimately challenge Murtha. Political support is one issue.It is not yet clear whether Russell will have any primary-election opposition from within his party. Irey last week would say only that she is focused on her current campaign for Washington County commissioner.Russell has met with local Republican leaders, who are not wading into the Murtha race just yet.“Right now, we’re focused on the Nov. 6 election,” said Ann Wilson, Cambria County Republican Committee executive director. “It’s too early to comment on the 2008 election.”Adequate fundraising also is a concern, though Russell said he hopes to buttress campaign cash with significant grassroots support.“There’s a lot of folks who might not have a whole lot of money to throw at a campaign but can donate some time and effort,” he said. “And I’m getting a lot of those types of promises.”

Marine cleared in Haditha case set to sue Murtha?

This makes three suits either pending or soon to be filed stemming from Murtha’s “in cold blood” comments last spring: SSgt. Frank Wuterich filed suit alleging defamation last August, Col. Jeffrey Chessani, commander of the Third Battalion that allegedly perpetrated the massacre, said he was thinking about it six weeks ago, and now apparently Lance Cpl. Justin Sharratt — against whom all charges have already been dismissed — told Sean Hannity he’s ready to jump in, too.
Exit question: Will a groveling, humiliating apology from Murtha suffice or will nothing short of monetary damages do? Exit answer: The former, because Murtha will invoke the Speech or Debate Clause (inappropriately) if they press ahead and try to hit him in the wallet.

Federal judge orders Murtha to testify in Haditha defamation case
A federal judge has ordered Rep. Jack Murtha (D-Pa.) to testify in a defamation case related to the deaths of Iraqi civilians in the town of Haditha in 2005, according to the Associated Press.
Murtha, a former Marine. accused Marines involved in the “cold-blooded murder and war crimes” during the Haditha incident. Frank Wuterich, a Marine sergeant involved in the incident, has sued Murtha for libel and invasion of privacy over his comments.
According to AP, U.S. District Judge Rosemary M. Collyer wants Murtha to explain why he made this statement and any documents he has related to the incident.
From the AP: ‘You’re writing a very wide road for members of Congress to go to their home districts and say anything they choose about private persons and be able to do so without any liability. Are you sure you want to do that?” Collyer said, adding later, ”How far can a congressman go and still be protected?”
Frankly, I don’t understand this ruling at all, and I wouldn’t be surprised if it is appealed by the Justice Dept. and/or House general counsel’s office on behalf of Murtha. Murtha, who can say some inappropriate things once in a while, was clearly acting in his capacity as a lawmaker when he made the comments and is thus protected by the Speech or Debate Clause from any type of prosecution for official acts.
Therefore, this case should have been dismissed, and I hope it will be. It’s not that I agree with what Murtha said. I don’t know enough about the incident to have an opinion whether Wuterich or the other Marines did anything improper or illegal. But Murtha has a right to say what he did under the Speech or Debate Clause, even if he was wrong about what happened. When we start restricting what members and senators can say in the performance of their jobs, then we are really in trouble as a country.
Update: There is a lot of confusion on the Speech or Debate Clause among Crypt readers, lawmakers, lawyers, public officials and the world at large, so I will try to explain it a little bit.
The Speech or Debate Clause does not protect members, senators or staff from arrest for a crime, and I am not suggesting that it does. If a member of Congress were to rob a bank or steal a car, he or she can be arrested and prosecuted for that crime. They have no constitutional privilege shielding them from the law on that front.
In addition, a lawmaker could libel someone if he or she were acting as a private citizen. That is entirely possible. Say I am a car dealer who sells Congressman X a new car, but he is unhappy about his purchase. Congressman X holds a press conference to announce to the world that I am “a damned crook who steals from everyone I sell cars to or have any other dealings with,” including my own mother. It is obvious that I can sue Congressman X for libel based on the fact that our interaction had nothing to do with his official duties as a member of Congress, but rather as Private Citizen X. He has no constitutional privilege there.
But what Murtha did was comment on an incident involving Wuterich and other Marines at a press conference and in a follow-up TV interview. These interviews were related to his opposition to the Iraq war. The courts have found that such press-related activities are a normal part of the duties of a member of Congress, and are therefore covered by the Speech or Debate Clause. Murtha did not have to be on the floor of the House making a speech in order to enjoy the protection of the Speech or Debate Clause. My apologies to the commenters who believe otherwise, but you are incorrect on that front. Read up on the case of former Rep. Cass Ballenger (R-N.C.) and his comments about a mosque near his home, and you’ll see what I’m saying.
In addition, Murtha said what he said about Haditha using information he received from Defense Dept. officials as the then ranking member of the Defense subcommittee of the House Appropriations Committee. This information was gleaned from his contacts inside the Pentagon, contacts he has made as a member of Congress for the last 35 years (Murtha was elected to the House in 1972).
Therefore. his comments are covered by the Speech or Debate Clause, and he cannot be charged with defaming Wuterich or anyone else. I am not saying Murtha is correct in what he said about Wuterich and his fellow Marines. I do not know whether his statement was accurate or not, and it would probably have been better if he’d never made ir. But Murtha clearly had the right to say it, and hopefully this decision will be overturned on appeal.
One final note — Wuterich may end up standing trial soon over his role in the death of 17 Iraqi civilians in the Nov. 19, 2005, incident in Haditha. If he were to go on trial and be found guilty of some crime in that case, then this lawsuit against Murtha would go away as well. Truth is the ultimate defense against libel, as any first year law or journalism student knows. I am not saying it will happen, and Wuterich is innocent of any wrongdoing as far as I know. But if it does happen, his legal action against Murtha would disappear. And my guess is that Wuterich’s fate will likely be decided before this lawsuit is resolved.
So, to restate what I said before, this is a very bad ruling by a judge who is clearly unfamiliar with how the Speech or Debate Clause works. I hope the decision is appealed by the Justice Dept. (which has represented Murtha in this lawsuit) or the House general counsel’s office and overturned. It is a legally unsound precedent and should be reversed as soon as possible.

More Charges Dropped in Haditha Case

CAMP PENDLETON, Calif. — Charges have been dropped against a captain who was accused of failing to investigate the deaths of 24 Iraqi civilians in the town of Haditha, the Marine Corps said Tuesday.
Capt. Lucas M. McConnell of Napa was granted immunity and ordered to cooperate with officials looking into the November 2005 killings, the Marines said in a press release.
Charges have now been dismissed against four of the eight Marines who were initially charged with murder or failure to investigate the deaths. A battalion commander has been recommended for a court-martial; a final decision is pending.
The killings occurred after a military convoy was hit by a roadside bomb that killed a Marine driver. Members of a Marine squad shot five men by a car, then killed 19 others as they cleared several houses in hopes of finding whoever set off the bomb.
Lt. Gen. James Mattis dismissed dereliction of duty charges against McConnell on Sept. 12. and determined that “administrative measures” were an appropriate punishment, the Marines said.
McConnell’s attorney, Kevin McDermott, did not immediately respond to a phone message.

We’ve just obtained video of Rep. Jack Murtha being directly confronted over repeatedly accusing the Haditha Marines of murdering Iraqis “in cold blood.” I’m editing and processing it now, so we should have it online before too long. Stand by.
Update: Here it is. The man confronting Murtha is Jason Mattera, of the Young America’s Foundation. You may remember Jason for his eloquent statement regarding CAIR’s attempt to silence Robert Spencer.

Update (AP): No member of the mainstream press was willing to put the question directly to Murtha at his National Press Club press conference so a blast from the blogosphere’s past had to do it for them. Via Gateway Pundit, Jeff Gannon endears himself to the left anew:
JEFF GANNON: In May 2006, you said that Marines killed innocent Iraqis citizens in cold blood at Hatitha. A year later, some of them have been exonerated. At some point are you going to apologize to these men?
REP. MURTHA: The trial’s not over yet.
JEFF GANNON: You’ve spoken out before. You went on national television and called these men “cold blooded killers.”
REP. MURTHA: The trial’s not over yet.
The Hill adds the irresistible detail that his face was “reddening” as he said it. Gannon did succeed in getting Murtha to make an uncomfortable admission on another subject but he deserves some traffic for this, so follow the link to find out what.

House Appropriations Defense subcommittee Chairman John Murtha (D-Pa.) said Monday that he expects that Republican lawmakers will begin abandoning President Bush’s Iraq policy after the GOP picks a presidential candidate next year.
“As soon as the primaries are over, you’ll see Republicans start jumping ship,” Murtha said in remarks at the National Press Club.
Murtha also predicted that, despite the unpopularity of Congress, Democrats will make broad gains in next year’s election because voters are upset with the war.
“People are frustrated, but you’re going to see a big Democratic increase,” he told reporters after his speech. “I think we’ll pick up 40 [to] 50 seats.”
The lawmaker, a key adviser to House Speaker Nancy Pelosi (D-Calif.) on military issues, is not waiting on the presidential calendar to push for a broad troop withdrawal from Iraq. Murtha said he expects the Iraq war supplemental spending bill, up for debate in October or November, to include a specific date for withdrawal.
During his hour-long presentation, Murtha said he was not familiar with legislation by Reps. Neil Abercrombie (D-Hawaii) and John Tanner (D-Tenn.) calling on President Bush to report on his withdrawal planning. Many centrists in both parties see the legislation as a vehicle for bipartisan action on Iraq in Congress.
Murtha also tersely said he would denounce the newspaper advertisement taken out by the liberal group MoveOn.org criticizing commanding Gen. David Petraeus as “General Betray Us.” Without elaborating, he said “Yes” when asked if he would distance himself from the ad.

LOS ANGELES — A Marine officer accused of failing to investigate Iraqi civilian deaths in Haditha rejected a plea deal under which his charges would have been dismissed in exchange for an admission that he covered up the killings, his attorney said Monday.
First Lt. Andrew Grayson is one of four Camp Pendleton officers who were charged with dereliction of duty on suspicion that they failed to probe the Nov. 19, 2005, assault that left 24 Iraqis dead.
Attorney Joseph Casas said Grayson has done nothing wrong, and the Marine said taking the deal would have been like selling his integrity.
“I was asked by the prosecution to fall on my sword for the greater good of the Marine Corps,” Grayson, 26, of Springboro, Ohio, said in a brief statement e-mailed to The Associated Press. “The prosecution wanted me to distort the truth to fit their end goal.”
The killings occurred after a military convoy was hit by a roadside bomb that fatally wounded a Marine driver. Members of a Marine squad shot five men by a car, then killed 19 others as they cleared several houses in hopes of finding whomever set off the bomb.
Grayson, an intelligence officer, is accused of telling a sergeant to delete photographs of the dead from his digital camera. He also faces charges of making a false official statement and obstructing justice.
The deal would have required Grayson to make a statement at a special, nonjudicial hearing admitting that he tried to cover up the killings, Casas said. Typically, such admissions can result in a letter of reprimand or lost pay and effectively end a Marine’s career.
Lt. Col. Sean Sullivan, the government’s lead prosecutor in the case, discussed a potential deal with Grayson, Casas said. Sullivan, reached for comment at his Camp Pendleton office, said military regulations prohibit him from discussing the case.
Four enlisted Marines were originally charged with murder, and four officers were charged with failing to investigate. So far, charges have been dismissed against two of the enlisted Marines and one officer.
Lt. Col. Jeffrey Chessani, the highest-ranking of the officers, has been recommended for a court-martial, but no final decision has been made by a general who oversees the cases.
Instead of taking the deal, Grayson will likely face a preliminary hearing in November, his attorney said. An officer overseeing the hearing could either recommend charges be dismissed or recommend he go to trial. The top general at Camp Pendleton would make the final decision.

If Marine Col. Jeffrey Chessani is exonerated of the charges against him he may haul Pennsylvania Democratic Congressman John Murtha, into court, suing him for libel, one of his lawyers told NewsMax.com.
Brian Rooney, one of the attorneys at Michigan’s Thomas More Law Center representing Lt. Col. Jeffrey Chessani and a former Marine captain himself told NewsMax.com that his client, who is alleged to have failed to fully investigate the killing of 24 Iraqis in Haditha November, 2005 and not reporting an alleged Law of War violation, may follow the example of another Haditha Marine, SSgt. Frank Wuterich who is suing Murtha for libel.
Murtha set off a media firestorm last year when even before the matter had been fully investigated he charged members of Kilo Company, 3rd Bn, 1st Marine Regiment had gone on a rampage and slaughtered 24 Iraqi civilians in cold blood to avenge the killing of a member of their unit in an IED explosion. He also said that the incident occurred in the absence of any firefight, although it occurred as part of a day-long battle with insurgent ambushers that wounded 11 Marines.
Rooney told NewsMax.Com that his group that, if as they expect, Chessani is cleared just as one officer, Capt. Randy Stone and two enlisted men have either been exonerated of had a hearing officer recommend exoneration they will seek to hold Murtha accountable.
According to Brian Rooney , SSgt. Frank Wuterich — one of the other defendants in the investigation now awaiting a hearing on murder charges — is already suing Murtha for those libelous comments. He insists that Murtha should be held accountable for taking the word of Iraqi insurgents and calling the Marines “cold-blooded murderers.”
“Staff Sergeant Wuterich’s attorneys are suing Congressman Murtha for liable for saying that the Marines were cold-blooded murderers, and that suit’s still ongoing,” Rooney said.
“We’re not suing Murtha right now,” Rooney added. “I know that Frank Wuterich’s attorney are suing him for libel, and we will explore that option once our criminal case has been concluded. We hope to show that Murtha is guilty of libel against our client because when he accused the unit’s officers of covering up the incident he could only have been referring to Lt. Col. Chessani.
Rooney recalled that in June 2006, Murtha told ABC’s Charles Gibson, “I know there was a cover-up someplace. They knew about this a few days afterwards, and there’s no question the chain of command tried to stifle the story.”
“We think Congressman Murtha abandoned his legislative role in attacking the Marines, and so we are going to explore that. We’re going to take it one step at a time, but that’s definitely something we’re going to do once our client is exonerated.”

WASHINGTON — Republicans returning to the House floor on Friday morning Aug. 3 after their walkout the night before were surprised to find as presiding officer the Democrat they call “King Corruption”: Rep. John Murtha of Pennsylvania, master of earmarks and backroom deals. Rep. Ed Pastor, a 64-year-old eight-term Democrat from Phoenix, Ariz., who is affable and well-liked by Republicans, had been scheduled to preside. But Speaker Nancy Pelosi, fearing parliamentary tricks by Republicans, put her muscleman Murtha in the chair.
Murtha’s performance as non-partisan presiding officer ran true to form. On a voice vote, Murtha ruled for Democrats when obviously more Republicans were on the House floor. He subsequently ordered a roll call vote, though members rising in support clearly fell short of the 44 required. After that ruling was challenged, Murtha declared: “The chair’s decision is not subject to question.”
HILLARY’S LEAD
Democratic insiders who are not neutral in the presidential race do not take seriously the USA Today/Gallup poll of Democratic voters showing Sen. Hillary Clinton 23 percentage points ahead of Sen. Barack Obama. They contend national surveys are meaningless because outcomes of the early state contests are still critical.
State polls show a virtual three-way tie among Clinton, Obama and former Sen. John Edwards in Iowa’s early caucuses. Clinton has only a narrow lead over Obama in New Hampshire’s opening primary. Obama has moved slightly ahead in the latest survey for South Carolina, the next primary state.
A footnote: Mitt Romney collects only 6 percent in the USA Today/Gallup national poll of Republicans but leads in Iowa and New Hampshire.
DISSENTER DIANNE
The Senate Judiciary Committee unexpectedly sent to the Senate floor the judicial nomination of former Mississippi Court of Appeals Judge Leslie Southwick, thanks to a defection by Democratic Sen. Dianne Feinstein of California that blindsided Judiciary Chairman Patrick Leahy.
The homosexual rights coalition has targeted for defeat President Bush’s nomination of Southwick to the 5th Circuit Court of Appeals (Texas, Louisiana and Mississippi). Leahy called for an immediate committee vote on Aug. 2, expecting that the nomination would be killed. According to Senate sources, Republican Whip Trent Lott appealed to Feinstein on grounds that the Republican-controlled Senate had confirmed President Bill Clinton’s judicial nomination of California liberal Richard Paez. Feinstein’s vote provided a 10 to 9 edge for Southwick.
A footnote: This dissent adds to liberal displeasure with Feinstein, who voted for extension of the Patriot Act and supported authority for federal eavesdropping of suspected terrorists without court warrants.

READING ABOUT RAHM
Rep. Tom Cole of Oklahoma, heading Republican efforts to take back the House in 2008, has advised his staffers at the National Republican Congressional Committee to read an account of how the Democratic Congressional Campaign Committee, under the chairmanship of Rep. Rahm Emanuel of Illinois, won the 2006 elections.
The book recommended by Cole is “The Thumpin’: How Rahm Emanuel and the Democrats Learned to Be Ruthless and Ended the Republican Revolution” by Naftali Bendavid.
Cole told me he believes Republican operatives should read Bendavid’s book because it “shows the Democrats were lucky to win” despite their mistakes. At a point of low Republican morale, Cole thinks the book demonstrates Democrats are not 10-feet tall.
YOUTH FROM PEORIA
Aaron Schock, a conservative 26-year-old Illinois state legislator, is privately boosted by national Republican operatives as their choice in a contested GOP primary next year to replace retiring seven-term Rep. Ray LaHood from the Peoria, Ill., district.
Schock would represent a rightward shift in the centrist representation of the solidly Republican district by LaHood for 14 years and by his old boss, former House Minority Leader Bob Michel, for the preceding 38 years.
Michel spent 20 years in the House Republican leadership, but LaHood’s ambitions to become a leader were frustrated by the post-Michel Republican caucus. LaHood considered but abandoned a run for governor of Illinois in 2006.
